What it means for a Scottish home, from the engineers who fit them.

If you’ve seen a headline about gas boilers being banned and started wondering if yours is next, the short answer is no, not if your home already exists. Scotland’s only enacted rule on this touches new-build properties, not the boiler currently keeping your radiators warm. Everything else you may have read, a 2035 deadline, a 2045 cut-off, a forced switch when you sell, is either a proposal still working its way toward Parliament or a claim that mixes up Scotland with a different policy south of the border.
This guide separates what’s actually in force from what’s been proposed, delayed, or dropped altogether, dated and sourced so you’re not relying on a tradesperson’s guess or a national headline written for an English audience. Scotland runs its own heating and building standards process, separate from Westminster’s, and the two get conflated in search results constantly. By the end you’ll know exactly where your existing gas boiler stands today, in October 2026, and what decision, if any, is actually yours to make.
There is no law in Scotland today that bans gas boilers in existing homes, and nothing forces you to remove a working one, on any date, including 2045. The only enacted Scottish rule that stops a gas boiler being fitted is the New Build Heat Standard, and it bites on new buildings going through building warrant, not on the house you already live in.
It is not illegal to install a gas boiler in an existing Scottish home in 2026. If your boiler fails tomorrow, a Gas Safe engineer can fit a new one, same as they could five years ago. Nobody, not your installer, not your council, not Holyrood, currently has the legal power to stop you. What has changed is the direction of travel: government policy is moving toward low-carbon heating, and a genuine, government-committed 2045 target exists. Direction of travel and legal compulsion are two different things, and mixing them up is where most of the anxiety around this topic comes from.
The New Build Heat Standard is the one piece of Scottish heating regulation with real legal teeth, and it only touches new construction.
Any new building whose building warrant application was submitted on or after 1 April 2024 cannot use a mains gas boiler, oil boiler, or LPG boiler as its primary heating system. That is the commencement date written into the regulations themselves.
A follow-up amendment, in force from 1 January 2025, then added two exceptions after a backlash over rural heating: bioenergy systems burning wood, biomass or peat are allowed, and so is secondary heating of any type alongside the main system.
For most new homes that main system is a heat pump.
So when did the gas boiler ban start? For new builds specifically, 1 April 2024 is the date that matters, because that’s when the warrant requirement began. Does the ban apply to your house? Almost certainly not, unless you’re building from scratch or converting a building. The Standard does reach some conversions, but only where the building already runs on a direct emission heating system and it is reasonably practicable to fit clean heating instead. A Victorian villa, a 1930s semi, a stone cottage that already has a gas connection: none of that falls under the New Build Heat Standard. It was written for developers, not homeowners with an existing boiler.

The piece of legislation that would eventually cover existing homes is the draft Buildings (Heating and Energy Performance) and Heat Networks (Scotland) Bill, usually shortened to the Heat in Buildings Bill. As of October 2026, it is not law, and it has not even been formally introduced to Parliament for a vote.
The Scottish Government paused the full Bill on 18 November 2025, when Cabinet Secretary Màiri McAllan told Holyrood it would not go before Parliament in the current session, citing the delay to the UK Government’s own Warm Homes Plan and the resulting uncertainty over electricity pricing. Instead, ministers published a draft Bill and draft explanatory notes purely to give industry and homeowners clarity on the direction of travel, not to be debated or voted on.
The Scottish Parliament has since reconvened after the May 2026 election, and the Bill still has not been introduced.
The Programme for Government published on 1 September 2026 commits to introducing it during 2026-27, with no date confirmed.
The government’s own stated commitment is to decarbonise heat in buildings “as far as reasonably practicable” by 2045, language that is deliberately technology-neutral and leaves room for exemptions in hard-to-treat properties, something McAllan flagged directly by noting that different technologies suit different housing types. Reports describing a mandatory grace period after buying a property remain unconfirmed at draft stage. What the draft actually contains is a power to set a Minimum Energy Performance Standard for owner-occupied and non-domestic buildings through future regulations, not a fixed window, so treat any specific figure you’ve read on this with caution.
One related change worth a brief mention: Scotland’s EPC system is being reformed, with new-style certificates and a revised rating method planned. The timetable has slipped: the Scottish Government dropped the October 2026 start it previously indicated, and amended regulations laid on 24 August 2026 would bring the reform fully into force on 30 April 2028, if Parliament agrees them. No mandatory minimum EPC rating currently applies to owner-occupied Scottish homes.
Two numbers keep surfacing in searches about this topic, 2035 and 2045, and they come from different places, only one of which is actually Scotland’s own policy.
2045 is Scotland’s figure. It’s the government’s stated ambition to decarbonise heat in buildings, expressed in the draft Heat in Buildings Bill as “as far as reasonably practicable,” not as an absolute date every boiler must be gone by. It came through the November 2025 pause to the Bill untouched, which suggests it’s a genuine commitment even as the mechanism for reaching it keeps changing.
2035 is messier, and almost none of it is Scottish. No gas boiler phase-out date for existing Scottish homes has ever been set in law. Scotland’s own 2023 and 2024 Heat in Buildings consultation did float a minimum energy efficiency standard for owner-occupiers by the end of 2033 and one for private rented properties by the end of 2028, but neither date appears in the current draft Bill. The 2035 figure itself comes from Westminster: the UK Government’s 2021 Heat and Buildings Strategy set an ambition that no new natural gas boilers be installed beyond 2035, and a separate off-gas-grid oil and LPG phase-out originally pitched for 2026 was pushed back to 2035 on 20 September 2023. Neither of those was ever Scottish policy. The current UK position is looser still: the Warm Homes Plan, published 21 January 2026, sets no phase-out date at all for gas boilers in existing homes, and leans on grants and finance instead of mandates. That plan is an England and Wales document, so it can’t settle anything for Scotland either way, but it is where most of the “boilers banned by 2035” coverage traces back to. England is separately requiring low-carbon heating in new homes under the Future Homes Standard, and that one now has a firm date: 24 March 2027, followed by a one-year transition for projects already in the pipeline. It applies to England only, with no bearing on Scotland.
If you’ve seen “gas boilers banned by 2035” in a headline, it was almost certainly written about English policy, or about a Scottish proposal that no longer exists in that form. Scotland and Westminster run separate legislative tracks on this, and the two get flattened into one story more often than either government would like.

If your existing gas boiler breaks down tomorrow, you have a genuine choice, and Scottish law does not narrow it. You can replace it like-for-like with another gas boiler, and no current regulation, enacted or draft, stops you doing that in an existing home. The New Build Heat Standard doesn’t apply because you’re not applying for a building warrant, and the Heat in Buildings Bill isn’t law yet, so no point-of-sale or replacement trigger currently binds you either.
That said, “can I” and “should I” are different questions. A like-for-like gas boiler replacement is fast and familiar, but it locks in another ten to fifteen years of gas prices and moves you no closer to the direction the government is clearly heading. There’s no ban forcing your hand today, and there won’t be one on a fixed date you can circle in a diary. But “no legal deadline” isn’t the same as “no reason to move,” and waiting for compulsion before you act is a worse financial decision than it looks.
Here’s why. The Home Energy Scotland grant currently pays up to £7,500 toward an air source heat pump, rising to £9,000 in rural and island areas, and it’s available now, while your existing boiler is still working and you have time to plan the install properly. Wait for a breakdown instead and you lose that runway: you’re choosing an installer under pressure, in whatever week your boiler happens to die, possibly in January, with no guarantee the grant scheme looks the same by then. A planned switch and a panic switch cost roughly the same on paper and feel completely different in practice.
The government’s direction hasn’t wavered even while the legal mechanism has; the 2045 commitment came through the November 2025 pause untouched. That’s a reasonable signal that gas heating gets structurally less attractive over the coming decade even without a ban, through rising carbon costs, tightening EPC expectations eventually, and a shrinking pool of installers still specialising in gas as the trade shifts toward heat pumps. Future-proofing your heating in Scotland means choosing your moment rather than having one chosen for you.
